Acceptance of the Terms
By using and visiting the pages at https://www.doktor-plus.com/ and the related content (including the website and the mobile application), you are deemed to knowingly accept these General Terms of Use, as well as all of their subsequent amendments, without prior notice or notification.
Definitions
For the purposes of these General Terms, the following terms have the meanings set out below:

- Doktor Plus Website / Website
- — the website https://www.doktor-plus.com/, operated for the market of Bosnia and Herzegovina and owned by BBlab Duško Bajić s.p. Banja Luka (hereinafter: BBlab), VAT/ID No.: 4511441040007, with its registered office at Nikole Pašića 40 3/9, 78000 Banja Luka, Bosnia and Herzegovina, through which users are enabled to access information about services, healthcare institutions and healthcare professionals, schedule medical consultations, communicate with service providers, and use other functionalities related to the provision of services through the platform.
- Doktor Plus Application / Application
- — the mobile application available for download via the Google Play and App Store platforms, operated for the market of Bosnia and Herzegovina and owned by BBlab, through which users are enabled to use the services available on the Website or functionally connected with it, including scheduling and carrying out medical consultations, communication and management of the user account.
- Doktor Plus (the Platform)
- — the Doktor Plus website and mobile application, as a single digital platform for the provision of online health-advisory services.
- General Terms
- — this document governing the contractual relationship between BBlab and the User, setting out the conditions and rules for the use of the Website and/or the Application, as well as the rights and obligations of the User in connection with the use of the services provided through the Website and/or the Application.
- Account
- — the user profile of a natural person created by registering on the Website and/or the Application, by entering basic identification data (first and last name, e-mail address and phone number), with mandatory verification of the account by means of a verification code that the Website and/or the Application delivers to the phone number entered by the user, all in accordance with the technical and security instructions determined by the Controller.
- Service
- — the provision of a digital platform through which users are enabled to access information about healthcare institutions and healthcare professionals, to schedule and carry out health-advisory services, to communicate between users (patients) and providers of healthcare services, as well as to use other functionalities and benefits that BBlab makes available through the Website and/or the Application.
- Account Registration
- — the process by which a natural person, when visiting the Website or using the Application, creates a user account by entering basic identification data (first and last name, e-mail address, phone number), thereby gaining the ability to use the services provided by the Controller.
- Website/Application Visitor
- — a natural person who accesses the content of the Doktor Plus Website and/or Application without registering a user account and without using health-advisory services.
- Notification Recipient
- — a natural person who is a Visitor or a registered User of the Website/Application and who has given explicit consent to receive notifications, a newsletter, informational or promotional messages by e-mail, telephone or other means of communication.
- Person Who Submitted an Inquiry
- — a natural person who is a Visitor or User of the Website/Application and who contacts Doktor Plus via the contact form, e-mail or telephone, in order to obtain information, answers to specific questions, or to exercise their rights in connection with the processing of personal data or the use of the services.
- Patient
- — a natural person who is a registered User and who, through the Website and/or the Application, schedules, uses or has used the health-advisory services provided by healthcare institutions or healthcare professionals through the Doktor Plus platform.
- User
- — the common term for a Visitor, a registered account user, a Notification Recipient, a Person Who Submitted an Inquiry and a Patient, depending on the specific activity and purpose of the processing of personal data.
- Healthcare Professional
- — a person who has completed secondary education in the field of healthcare, an integrated academic study of the first and second cycle of medicine, dentistry or pharmacy, or the first cycle of an academic or professional study, or an equivalent in the field of health education and health protection, who directly provides healthcare services.
- Private Healthcare Institution / Clinic
- — an entity which, in accordance with the Healthcare Act of the Republic of Srpska and the Healthcare Act of the Federation of Bosnia and Herzegovina, is registered to perform healthcare activities and which, through the Website and/or the Application, provides health-advisory services to users (patients).
Introduction
Doktor Plus is an information-society service within the meaning of applicable legislation, acting as a technical intermediary between users and private healthcare institutions.
Private healthcare institutions that provide services through the Platform act as independent providers of healthcare services, with which BBlab has concluded a business-cooperation agreement in order to enable the technical realization of online consultations.
During the use of the Doktor Plus platform, the applicable regulations of Bosnia and Herzegovina and the Republic of Srpska apply, in particular the Law on Obligations, the Consumer Protection Act, the Electronic Commerce Act of the Republic of Srpska, and these terms of use.
BBlab is authorized to amend the content of the General Terms at any time and without prior notice. Changes take effect at the moment of publication on the pages of this website and mobile application and, as such, apply to all current and future users. BBlab is not obliged to send individual notifications about changes to the General Terms to each user.
The User is obliged to read the General Terms regularly.
Article 1. Description of the Service
1.1. Doktor Plus is a digital platform available via the website and the mobile application, through which users are enabled to access information about healthcare services, private healthcare institutions/clinics and healthcare professionals, to schedule and carry out health consultations, to communicate between users (patients) and providers of healthcare services, as well as to use other functionalities related to the provision of health-advisory services through the platform.
1.2. The Doktor Plus platform enables users to review the profiles of private healthcare institutions/clinics and healthcare professionals, available consultation slots and the types of services provided, as well as to book and use health-advisory services through the platform in accordance with the conditions available on the platform.
1.3. Private healthcare institutions/clinics act as independent providers of healthcare services and are responsible for the expertise, lawfulness and quality of the health consultations provided.
1.4. By creating a user account and using the Doktor Plus platform, the user accepts that their data may, to the extent necessary for the use of the service and in accordance with the Privacy Policy, be made available to private healthcare institutions/clinics and healthcare professionals for the purpose of providing the health-advisory service.
1.5. The Doktor Plus platform does not establish a healthcare relationship between BBlab and the User, but exclusively between the User and the private healthcare institution/clinic.
1.6. The User may stop using the platform's services at any time, and may request the deletion of their user account in accordance with the Privacy Policy and these General Terms.
Article 2. Payment for Health-Advisory Services
2.2. The Doktor Plus platform may enable the use of free and paid functionalities, depending on the type of service used.
2.3. Free functionalities may include reviewing information about healthcare institutions/clinics, reviewing available appointment slots, registering a user account, as well as using certain informational and communication functionalities of the platform.
2.4. Paid services in particular include the scheduling and carrying out of health-advisory services through the platform, as well as any additional functionalities available to users.
2.5. Payment for health-advisory services is made directly to the benefit of the private healthcare institution/clinic that provides the relevant healthcare service.
2.6. Payment is technically carried out through an authorized payment-services provider, which enables secure electronic payment through the Doktor Plus platform. The Doktor Plus platform does not receive, retain or dispose of the funds paid for healthcare services, but acts exclusively as a technical intermediary in the payment process.
2.7. The private healthcare institution/clinic acts as the provider of the healthcare service and the issuer of the invoice for the healthcare service provided, and bears responsibility for the lawfulness, calculation and tax treatment of the service provided.
2.8. Detailed payment conditions, service prices, the method of calculation, as well as the rules for cancelling consultations, are available to the user before confirming the booking of a healthcare service through the platform.
Article 3. Your Representations and Warranties
3.1. By registering on the Doktor Plus Platform, you represent and warrant the following:
- (i) you warrant and represent that you are at least eighteen (18) years of age and have full legal and contractual capacity to enter into this agreement and to comply with all of its terms and conditions;
- (ii) the information you provided to the Doktor Plus Platform upon registration is accurate and complete;
- (iii) you will comply with all laws applicable to your use of the Website and the Platform;
- (iv) you will not interfere with the use and enjoyment of the Website and the Platforms by third parties;
- (v) you will not interfere with or impair the security measures of BBlab, i.e. of the Doktor Plus platform or its suppliers;
- (vi) if any information you provide to the Doktor Plus platform becomes inaccurate, incomplete or otherwise false or misleading, you will immediately notify Doktor Plus, i.e. BBlab;
- (vii) you access the website and application for yourself or for a child under eighteen years of age for whom you are the legal guardian.
3.2. The Service is intended for adults who are at least eighteen (18) years of age and have full contractual capacity. By accessing or using the Platform, the user represents and warrants that they meet the stated conditions.
3.3. Minors may use the Service exclusively through and with the mediation of their legal representative (parent or guardian), who, on their behalf:
- creates and manages the user account;
- gives consent for the processing of personal data;
- initiates and approves the use of healthcare services through the Platform;
- accepts the General Terms and the Privacy Policy.
3.4. In cases where the Service is used on behalf of a minor, the legal representative represents and warrants that they have the right to act on behalf of the minor and that they bear full responsibility for the use of the Platform on the minor's behalf.
3.5. Doktor Plus does not knowingly collect personal data of children without the consent of a legal representative. Should it be established that a minor's data has been collected without appropriate consent, Doktor Plus reserves the right to delete such data without delay.
3.6. In accordance with applicable regulations and taking into account available technology, Doktor Plus will make reasonable efforts to verify whether consent on behalf of a minor was given or approved by a legal representative.
3.7. The healthcare institution may require additional verification of the identity and consent of the legal representative before providing a healthcare service to a minor.
Article 4. Nature of the Platform
4.1. Doktor Plus is a digital platform that enables the technical connection of users (patients) with private healthcare institutions/clinics and healthcare professionals, for the purpose of providing information, scheduling and carrying out health-advisory services by means of electronic communication.
4.2. The Doktor Plus platform acts as an information-society provider and a technical intermediary in the communication between users and providers of healthcare services, and does not provide healthcare, medical diagnostics or therapy.
Article 5. Responsibility of Private Healthcare Institutions/Clinics
5.1. Private healthcare institutions/clinics and healthcare professionals that provide health-advisory services through the Doktor Plus platform act as independent providers of healthcare services and are independently responsible for:
- the expertise, lawfulness and quality of the health consultation provided;
- medical assessments, diagnoses, therapeutic recommendations and medical advice;
- keeping medical records and processing health data in accordance with special regulations;
- meeting the professional and ethical standards of healthcare activity.
5.2. The Doktor Plus platform bears no responsibility for the medical content of consultations, nor for the actions or decisions of private healthcare institutions/clinics and healthcare professionals.
5.3. The User confirms that they understand that a health consultation by means of electronic communication may have limitations compared with a conventional medical examination.
Article 6. Limitation of the Platform's Liability
6.1. Doktor Plus does not guarantee the accuracy, completeness, timeliness or applicability of the medical information provided by private healthcare institutions/clinics or healthcare professionals through the platform.
6.2. All medical advice, recommendations and information obtained through the platform are used at the user's own responsibility and do not constitute a substitute for a direct medical examination, diagnostics or treatment, except to the extent permitted by applicable regulations and the professional standards of healthcare activity.
6.3. Doktor Plus does not guarantee that the use of the platform will lead to the achievement of any particular health outcome, nor does it assume responsibility for any consequences arising from the use of health-advisory services.
Article 7. Emergency Medical Situations
7.1. The Doktor Plus platform is not intended for providing emergency medical assistance or for resolving medical conditions that require immediate intervention.
7.2. In the event of an urgent or life-threatening health condition, the user is obliged to contact the competent emergency medical service without delay or to go to the nearest healthcare institution.
Article 8. Accuracy of the Information Available on the Platform
8.1. The information published on the Doktor Plus platform serves exclusively for informational purposes. Doktor Plus makes reasonable efforts to ensure the accuracy and timeliness of the information, but does not guarantee the completeness or accuracy of all published data.
8.2. Doktor Plus reserves the right to amend the content of the platform at any time, without any obligation to notify users in advance.
Article 9. Technical Availability of the Service
9.1. Doktor Plus makes reasonable efforts to ensure the continuous and secure operation of the platform, but does not guarantee that the platform will be available without interruptions or technical difficulties.
9.2. Doktor Plus bears no responsibility for temporary unavailability of the platform arising from technical failures, system maintenance, problems in the operation of electronic communication networks, or other circumstances beyond the platform's control.
Article 10. Use of the User Account
10.1. The User is responsible for safeguarding their access data and the security of the user account.
10.2. All activities carried out through the user account are deemed to be the activities of the user, unless the user notifies Doktor Plus without delay of a suspicion of unauthorized use of the account.
10.3. Doktor Plus reserves the right to refuse registration, to restrict functionalities, or to temporarily or permanently suspend a user account in the event of a breach of these General Terms or misuse of the platform.
Article 11. Protection of Intellectual Property
11.1. The Doktor Plus platform (the Website and the Application), including its software, design, structure, graphical interface, textual content, databases, functionalities, algorithms, reports, technical solutions and other elements, are protected by the Law on Copyright and Related Rights of Bosnia and Herzegovina.
11.2. The copyright and other intellectual-property rights in the Platform, including the software solution, source code, databases, design, functionalities, content and all of their modifications, upgrades and derivative works, belong entirely to BBlab Duško Bajić s.p. Banja Luka, as the exclusive holder of the rights.
11.3. No ownership right over the software is transferred to users; instead, only a limited, non-exclusive, non-transferable right of use is granted for the purpose of accessing and using the services in accordance with these Terms.
Article 12. Prohibited Uses
By using this platform, you agree that you will not:
- send or otherwise transmit to or through the Website and the platforms any unlawful, harmful, harassing, defamatory, threatening, hateful or otherwise inappropriate material of any kind, any material that may cause damage to or delay of the Website and the platforms or computers of any kind, or any unsolicited advertising, offers or promotional material;
- misrepresent your identity in any way;
- restrict or prevent any person from using the Website and the platforms, disclose personal data obtained from the Website and the platforms, or collect information about users of the Website and the platforms;
- reverse-engineer, disassemble or decompile any part or technology of the Website and the platforms, or attempt to do any of the foregoing;
- gain unauthorized access to the Website and the platforms, to other users' accounts, names, personal data or other information, or to other computers or websites linked to or connected with the Website and the platforms;
- launch or use any automated systems (including "robots", "crawlers", "scrapers", scripts and similar tools) to access the Website, the Application or the server infrastructure of the Doktor Plus Platform in a manner that generates an excessive number of requests or enables the automated collection of data without the prior written consent of the service provider;
- send or otherwise transmit to or through the Website and the platforms chain letters, unsolicited messages, so-called "spamming" or "phishing" messages, or messages advertising goods and services;
- publish, transmit or otherwise make available any virus, worm, spyware or any other code, file or program that may, or is intended to, damage or interfere with the operation of any hardware, software or telecommunications equipment;
- violate any applicable laws or regulations in any way;
- alter or modify any part of the content or services offered on or through the Website and the platforms;
- allow any other person to use the Platforms with your registration or login data;
- breach or otherwise circumvent the security or authentication measures of the Doktor Plus platform;
- remove or alter copyright notices, trademarks or other proprietary notices;
- assist or allow any person to engage in any of the activities described above.
Article 13. Termination and Suspension of Access
13.1. In the event of a breach of these General Terms, the Doktor Plus Platform reserves the right, at its own discretion and without prior notice, to temporarily or permanently restrict, suspend or terminate the User's access to the Website, the Application or particular functionalities of the Platform.
13.2. This measure does not affect other rights and legal remedies available to the service provider in accordance with applicable legislation.
13.3. The Platform provider shall bear no liability towards the User or towards third parties for the suspension or termination of access carried out in accordance with these Terms.
13.4. The User may stop using the Platform at any time, whereupon these Terms cease to apply in relation to that User, except for those provisions which, by their nature, remain in force after the cessation of use (including, but not limited to, the disclaimer of warranties, the limitation of liability and the protection of intellectual-property rights).
13.5. After these Terms cease to apply, the User is obliged to immediately stop further use of the Platform.
Article 14. External Links
14.1. The Doktor Plus Website and/or Application may contain links to the websites and platforms of third parties, including the pages of healthcare institutions, partners or other service providers.
14.2. Such pages are not under the control of the Doktor Plus Platform provider, and Doktor Plus bears no responsibility for the content, accuracy, lawfulness or security of the data available on those pages.
14.3. The placement of a link does not imply that Doktor Plus endorses, guarantees or stands behind the content, products or services of third parties.
14.4. The User accesses third-party websites at their own responsibility and in accordance with the terms of use and privacy policies of those sites.
14.5. These General Terms do not apply to third-party websites.
Article 15. Indemnification and Limitation of Liability
15.1. The User undertakes to indemnify and hold harmless the Doktor Plus Platform provider, its responsible persons, employees, associates and affiliated companies from all claims, damages, costs and expenses (including reasonable legal-representation costs) that may arise from:
- a) a breach of these General Terms by the User;
- b) unlawful or unauthorized use of the Platform;
- c) the submission of inaccurate, incomplete or misleading information through the Platform.
15.2. Doktor Plus is not liable for any damage that may arise in connection with the use of, or the inability to use, the Platform.
15.3. Doktor Plus bears no responsibility for any interruptions of operation, technical disturbances, errors in the functioning of the system, failures of communication networks, or for events that are beyond the reasonable control of the Platform provider (force majeure).
Article 16. Use and Protection of Data
16.1. Doktor Plus takes care of the protection of personal data in accordance with applicable regulations and the Privacy Policy: https://doktor-plus.com/privacy, which regulates in more detail the collection of personal data, its use, security, storage, deletion and transfer.
16.2. The User is obliged to maintain the confidentiality and security of the data that enables access to the Account, including verification codes and other security elements used in the user-authentication process.
16.3. The User must not disclose, transfer or otherwise make available to third parties the verification codes or other security data used to access the Account.
16.4. The User bears responsibility for all activities undertaken through their Account if such activities are the result of unauthorized use of security elements to which they had access or which they made available to third parties.
16.5. Doktor Plus, i.e. BBlab, is not liable for damage arising from the unauthorized use of the Account, verification codes or other security elements by third parties. However, after the user notifies Doktor Plus without delay of a suspicion of unauthorized access, loss of control over the phone number associated with the Account, or possible misuse of the Account, Doktor Plus will take reasonable technical and organizational measures in order to protect the user's Account and prevent further misuse.
Article 17. Reporting Irregularities and Misuse
17.1. Registered Users have the right to report the following via e-mail at podrska@doktor-plus.com:
- inappropriate, unlawful or inaccurate content;
- suspicion of misuse of a user account;
- infringement of the rights of third parties;
- technical irregularities or inaccurate information published on the Platform.
17.2. A User who submits a report is obliged to substantiate the report and, where possible, provide relevant information that may assist in considering the allegations.
17.3. Doktor Plus reserves the right, at its own discretion, to examine the allegations in the report and take appropriate measures, including:
- temporary restriction of access;
- removal of content;
- suspension or deactivation of the user account;
- notifying the competent authorities, if there is a suspicion of a breach of the law.
17.4. The submission of a report does not guarantee that measures will be taken automatically; rather, each report will be considered in accordance with applicable regulations and the Platform's internal procedures.
Article 18. Third-Party Claims
18.1. In accordance with these General Terms and the Electronic Commerce Act of the Republic of Srpska, Doktor Plus bears no responsibility for information entered by users of this website, to which information Doktor Plus merely provides access.
18.2. Doktor Plus is released from any form of liability for the searching of content in a virtual listing, for temporary transient storage (caching), for the storage of third-party content (hosting) at the user's request, as well as for any enabling of access to third-party information (linking).
18.3. Any disputes arising from the relationship between the user and the provider of healthcare services, or any third party, are resolved exclusively between the provider of healthcare services and the user.
Article 19. Jurisdiction
19.1. In addition to closing the user account, Doktor Plus reserves the right to take other appropriate measures against users who breach these Terms and rules of use.
19.2. The terms and the relationships between users and the company BBlab are subject to the laws of Bosnia and Herzegovina / the Republic of Srpska.
19.3. In the event of a dispute, the court in Banja Luka has jurisdiction.
